OUR LAWFUL BASES FOR USING YOUR INFORMATION

Data protection law requires us to have a lawful basis for processing personal information.

Depending on the circumstances, we may rely on:

CONTRACT

We may process your information where it is necessary to provide the membership, sessions or other services you have purchased from us, or to take steps at your request before entering into a contract.

For example, this includes administering your membership and processing your bookings.

LEGAL OBLIGATION

We may process information where necessary to comply with a legal or regulatory obligation, such as accounting, tax or record-keeping requirements.

LEGITIMATE INTERESTS

We may process information where it is necessary for our legitimate interests, provided that those interests are not overridden by your rights and interests.

This may include administering and improving WHELMED Club, maintaining security, preventing misuse of our services and managing our business.

CONSENT

Where the law requires consent, we will ask for it.

For example, where applicable, we may ask for consent before using non-essential cookies or sending certain types of direct marketing.

Where processing is based on consent, you may withdraw your consent at any time.

WHO DO WE SHARE YOUR INFORMATION WITH?

We may share personal information with trusted third parties where necessary to operate WHELMED Club.

These may include:

SQUARESPACE

whelmedclub.com and our membership functionality are operated using Squarespace. Squarespace may process information on our behalf in connection with website hosting, membership management, payments and related services.

PAYMENT PROVIDERS

Payments may be processed by payment providers integrated with Squarespace. These providers may process payment and transaction information to complete payments, prevent fraud and meet legal obligations.

GOOGLE WORKSPACE

We use Google Workspace for business email and communications. Information you send to us by email may therefore be processed through Google's services.

WHATSAPP

The WHELMED Club WhatsApp Community is provided through WhatsApp, operated by Meta.

If you join the WHELMED Club WhatsApp Community, information such as your name, profile information and telephone number may be visible to other members depending on your WhatsApp settings and the functionality available within WhatsApp.

WhatsApp is a third-party service and its use is also subject to its own terms and privacy practices.

We may share information with professional advisers, insurers, accountants, legal advisers, regulators, law enforcement or other authorities where reasonably necessary or where we are legally required to do so.

We do not sell your personal information.

WHELMED CLUB COMMUNITY AND MEMBER PRIVACY

WHELMED Club is a community environment, and some membership features involve interaction with other members.

You should therefore be mindful that information you voluntarily make visible to other members — particularly through WhatsApp — may be seen by those members.

We ask all WHELMED Club members to respect one another's privacy and not to share another member's personal information outside the community without their permission.

However, because WhatsApp and other third-party platforms are not operated by WHELMED Club, we cannot guarantee how another member may use information that is visible to them.

HOW LONG DO WE KEEP YOUR INFORMATION?

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including to:

Different categories of information may therefore be retained for different periods.

When information is no longer required, we will take reasonable steps to securely delete or anonymise it.

HOW DO WE PROTECT YOUR INFORMATION?

We take reasonable technical and organisational measures to protect personal information against accidental loss, misuse, unauthorised access, alteration or disclosure.

However, no internet-based service or electronic storage system can be guaranteed to be completely secure.

INTERNATIONAL TRANSFERS

Some of the third-party services we use may process personal information outside the United Kingdom.

Where personal information is transferred internationally, we will take appropriate steps to ensure that the transfer is carried out in accordance with applicable data protection law.

The safeguards used may include adequacy regulations or other legally recognised transfer mechanisms where applicable.
